Thus far this is just a bipartisan handshake agreement – no bill has been drafted yet, but this seems to be what is being agreed to, to replace HR7910, which was unlikely to pass.
Highlights of what’s included :
-
Funding for Red Flag laws – states can still decide on their own if they wish to implement
-
Mental Health investments – $8 Billion being allocated for Mental Health services to focus on firearm awareness and safety
-
Boyfriend Loophole closure – you can be barred from owning firearm if ever had abuse conviction. Prior, only married partners could.
-
Enhanced background review for buyers under 21 – including a 10 day waiting period until 21 years old.
-
FFL requirements – anyone selling a firearm for any profit over original purchase price – will need an FFL
-
School Safety and Security funding. Funding (amount unknown – but they are looking to use up some of the $150Billion left from COVID relief)
what was removed coming from HR7910
-
No bans – magazines/rifles/semi autos/ghost gun regulations all removed
-
expanded background checks removed
-
Higher Minimum age of purchase requirement removed
Fundamentally, this looks better. I know some folks will have issues, especially with the Red Flag laws, but I think it’s huge for Mental health and school safety. Only concern with this, is that it’s SO conveniently beneficial for 2A – almost shockingly so – that I suspect bribes took place. All that funding allocation looks like the representatives took a look at the mass shootings… and said “let’s see how we can divert money to our bank accounts from this”.

1.Red flag laws are a violation of due process
2.$8b is a drop in the bucket compared to what’s actually needed.
3.Gender discrimination bc men are far more likely to be convicted is DV cases than women. See Depp v Heard.
4.Actual violation of 2a. Shall not be infringed does not mean a 10 day waiting period is ok. Us code 10 defines the unorganized militia as any able bodied male 17 and up.
5.Sounds vague. Not sure how it addresses gun crimes. If a gun goes up in value’ I can’t sell it for the market price?
6.Sure, more school safety is needed. But could we at least ask police to serve and protect rather than standing and waiting? May need to overturn Castlerock v Gonzalez but I think the senate could get the ball rolling.
